1.1The rule
No session is recorded unless both participants give express consent before that session starts. Consent is given each time, through a blocking screen, with an unchecked box for each participant. It is never bundled with any other consent, never inferred from continued use, and never carried over from a previous session.
1.2Why it is built this way
Several United States states require the consent of all parties to record a conversation. Recording without it is a criminal offence in those states and several give the recorded person a private right of action with statutory damages per recording.
In Canada, one party consent is not available to Nurvimo, because Nurvimo is not a participant in the conversation. A platform that records a private conversation without the consent of a participant is intercepting it.
Privacy law on both sides of the border requires meaningful, informed, purpose specific consent, and recording a session in which someone discusses their business, their money or their life is a high sensitivity processing activity.
Users are in different provinces and states and Nurvimo cannot reliably determine the applicable rule at session time. Dual express consent is the only rule that is correct everywhere.
1.3How it works
- Both participants see the consent screen when they join. Default state is off.
- Either participant may join without recording. If either declines, no recording is made and the session proceeds normally.
- While recording, a visible indicator is shown to both participants for the whole session.
- Either participant may stop the recording at any time, and the recording stops immediately for both.
- Consent, declines, start and stop events are logged with a timestamp against the booking.
1.4What users may not do
Participants may not record by any other means, including screen capture software, a phone, or a separate device, and may not transcribe, photograph or share a session without the other participant's written consent. Publishing any part of a session, including a screenshot of the chat, without consent is a breach of the Terms and may be unlawful.
1.5Storage, access and retention
- Recordings are encrypted in transit and at rest.
- Access is limited to the two participants and to named Nurvimo Trust and Safety staff, who may access a recording only to investigate a report, a dispute, or a legal request, and every access is logged.
- Recordings are deleted 90 days after the session unless a dispute or legal hold is open.
- Either participant may request deletion at any time. If the other objects, we retain it only for the duration of any open dispute.
- Recordings are never used for advertising, never used to train models, and never shared with anyone outside the participants except as required by law.
1.6Category restrictions
Recording is unavailable in categories where highly sensitive disclosure is likely, currently Lifestyle and Wellbeing.
1.7Session conduct
Participants will join from a private setting, will not bring uninvited people into a session, will not use virtual backgrounds or filters to misrepresent identity, and will not display or share illegal content. Sessions may not be streamed to third parties.
